Terms and Conditions

These Terms & Conditions (“Terms”) govern your access to and use of leafcatcher.store (the “Site”) and purchases from LeafCatcher (“LeafCatcher,” “we,” “us,” or “our”). By accessing the Site or purchasing from us, you agree to these Terms. If you do not agree, do not use the Site.

1) About us & contact

2) Eligibility & accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction).

  • You’re responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us of any unauthorized use immediately.

  • We may refuse service, close accounts, or cancel orders at our discretion.

3) Orders, pricing & payment

  • Order acceptance. Your order is an offer to buy; we may accept or reject it at our discretion (e.g., product availability, suspected fraud, pricing or description errors).

  • Pricing & errors. Prices may change without notice. If we discover an error, we may cancel the order or contact you for instructions before shipping.

  • Taxes & fees. You are responsible for applicable sales taxes, duties, and shipping fees shown at checkout.

  • Payment. We accept the payment methods shown at checkout (e.g., credit/debit cards, PayPal, Shop Pay/Apple Pay/Google Pay). By submitting a payment, you represent you’re authorized to use the method and you authorize us (and our payment processor) to charge the full amount.

  • Fraud checks. We may require additional verification before accepting any order.

  • Promotions & coupons. Discounts can’t be combined unless stated; promos may be limited by time, quantity, or region. Terms for specific offers apply.

Optional — Buy Now, Pay Later (BNPL): If available, BNPL options are provided by third-party providers subject to their terms. We are not a party to your financing agreement.

4) Shipping, delivery & risk of loss

  • We ship to the locations listed at checkout using the carriers offered. Estimated delivery dates are estimates only.

  • Risk of loss and title transfer to you upon delivery to the carrier or when the order is delivered to the address you provided (as permitted by law).

  • You’re responsible for accurate shipping information; we’re not liable for delays or losses due to incorrect addresses.

  • International orders may incur customs, duties, or import fees payable by you.

5) Returns, refunds & exchanges

  • Unless stated otherwise, items must be returned unused and in original packaging within [X] days of delivery. Certain items may be final sale (e.g., clearance, custom items).

6) Product information & installation/use

  • We aim for accurate descriptions, images, and specifications, but minor variations may occur (e.g., color/finish due to screen display).

  • You’re responsible for proper installation and use of products per instructions. We are not responsible for damage resulting from improper installation, misuse, or failure to follow instructions.

7) Subscriptions / Auto-renewals (optional)

  • If you enroll in a subscription, it will auto-renew at the stated interval until you cancel.

  • We’ll bill your saved payment method at each renewal.

  • You can cancel any time before the next renewal in your account or by contacting us at [Email]. Fees already paid may be non-refundable unless required by law.

8) User content (reviews, photos, comments)

  • If you submit reviews, photos, or other content (“User Content”), you grant LeafCatcher a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works in any media for marketing, promotion, and Site operation.

  • You represent you own or control the rights to your User Content and that it does not violate law or others’ rights.

  • We may remove or edit User Content at our discretion.

9) Intellectual property

  • The Site, products, text, graphics, logos, icons, images, videos, and software are owned by LeafCatcher or our licensors and are protected by IP laws.

  • You’re granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes.

  • No scraping, data mining, reverse engineering, or derivative use of the Site or its contents is permitted without prior written consent.

10) Acceptable use

You agree not to:

  • Violate law or others’ rights;

  • Upload malicious code or interfere with Site functionality;

  • Circumvent security or access controls;

  • Use the Site for fraudulent activity, unsolicited marketing, or to collect users’ information without consent.

11) Third-party services & links

The Site may link to third-party websites or integrate third-party services (e.g., payment processors, analytics, shipping tools). Those services are governed by their own terms and privacy policies. We’re not responsible for third-party acts or omissions.

12) SMS & email communications (optional)

  • By providing your phone number/email, you consent to receive transactional messages (order updates).

  • Marketing SMS/emails require your consent where required by law. You can opt out by replying STOP to SMS or using the unsubscribe link in emails. Message/data rates may apply.

13) Disclaimer of warranties

To the maximum extent permitted by law:

  • The Site and products are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

  • We do not warrant uninterrupted, error-free, or secure access to the Site.

14) Limitation of liability

To the maximum extent permitted by law:

  • LeafCatcher and our affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site or products.

  • Our total liability for any claim shall not exceed the amount you paid to us for the product(s) at issue during the 12 months preceding the claim.

Some jurisdictions do not allow certain limitations; in such cases, the above limitations apply to the fullest extent permitted.

15) Indemnification

You agree to indemnify, defend, and hold harmless LeafCatcher and our affiliates, officers, employees, and agents from any claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site or products, or your violation of law or third-party rights.

16) Dispute resolution; arbitration; class-action waiver (optional but recommended)

  • Informal resolution. Contact us first at [Email]; we’ll try to resolve disputes informally within 30 days.

  • Binding arbitration. Except for small-claims matters, any dispute arising out of or relating to these Terms or your use of the Site/products will be resolved by binding arbitration administered by [AAA/JAMS] under its rules.   • Class waiver. You and LeafCatcher agree to waive any right to participate in a class action or class-wide arbitration.

Consumers in jurisdictions that prohibit mandatory arbitration/class waivers are not bound by this Section.

17) Governing law & venue

18) Export & sanctions compliance

19) Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, labor disputes, war, terrorism, internet or utility failures, acts of government).

20) Changes to the Site or Terms

We may modify the Site and these Terms at any time. Changes are effective upon posting with the “Last updated” date. Your continued use constitutes acceptance of the changes.

21) Severability; assignment; entire agreement; waiver

If any provision is found unenforceable, the remaining provisions remain in effect. You may not assign your rights without our consent; we may assign ours. These Terms (plus policies referenced herein, including our Privacy Policy) constitute the entire agreement between you and LeafCatcher. Our failure to enforce a provision is not a waiver.

22) DMCA/copyright notices (optional)

If you believe content on the Site infringes your copyright, send a DMCA notice to [DMCA Agent Name/Title], [Address], [Email] with: (i) your contact info; (ii) identification of the copyrighted work; (iii) identification of the infringing material and its location; (iv) a statement of good-faith belief; (v) a statement under penalty of perjury that the information is accurate and you are authorized; (vi) your physical or electronic signature.
